Claims, Exchanges
The goods must be checked immediately upon receipt; bottle breakage must be confirmed by the carrier. Return without stated reason must be within 8 days. The return transport must be paid by the purchaser. In addition, an exchange without stated reason can be made during regular opening hours of the winery.

Faulty Cork
Impairments due to a faulty cork are not the responsibility of the winemaker/winery. An exchange of a faulty bottle is possible under the following conditions: The defective bottle must be closed with the faulty cork, and it must be returned to the Schmidl Winery.

Retention of Ownership
All goods remain our property until full payment is made.

Protection of Data
Customer data are used exclusively within the winery and of course are not passed on to third parties.

Information about the Right
of Withdrawal / Cancellation
(hereinafter referred to as “withdrawal”)
If you are a consumer within the scope of the Consumer Protection Law, you have the right to withdraw from this contract within fourteen days without stating a reason. The cancellation period is determined as follows:

In the case of a contract of sale, fourteen days from the day on which you are a third party named by you, who is not the carrier, has taken possession of the good/s.

In the case of a contract for multiple goods ordered by the consumer under a single order and delivered separately, fourteen days from the date on which you or a third party named by you, who is not the carrier, has taken possession of the final good/s.

In the case of a contract for the delivery of goods in several instalments or pieces, fourteen days from the date on which you or a third party named by you, who is not the carrier, has taken possession of the last partial delivery or last good/s.

In the case of a contract for the regular delivery of goods for a fixed period of time, fourteen days from the date on which you or a third party named by you, who is not the carrier, has taken possession of the first good.

by means of a clear statement (such as a letter sent by post or e-mail) of your decision to withdraw from this contract. You may, but are not required to, use the attached model withdrawal form.

Consequences of withdrawal:
If you withdraw from this contract we will return all payments we have received from you, including delivery charges (with exception of additional costs arising from your choice of a delivery means other than the standard one that we offer) immediately and no later than fourteen days from the day on which we receive notification of your cancellation of this contract. For the return payment, we will use the same means that you used in your original transaction, unless otherwise expressly agreed with you; in no case will you be charged repayment fees. We reserve the right to refuse repayment until we have received the good/s or until you have provided proof that the goods have been returned, whichever occurs earlier.
If you have received goods in connection with the contract, you must return the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the end of the fourteen-day period.

We bear the immediate costs of returning the good/s. You must only pay for any loss of value of the goods, if this loss of value is due to damage occurred due to a handling that is not necessary to check the nature, characteristics and functionality of the goods.

If possible, please send the good/goods back to us in in the original packaging. The use of original packaging is not a “must” and by no means a requirement for the assertion of your right of withdrawal, it simply simplifies the settlement for us.
